Background

Baker & McKenzie were requested by Olive Business to research and advise on a number of legal topics relevant to the olive oil business and market. They were asked to research the following:

a)	The position where a supplier has delivered the wrong variety of olive trees resulting in a yield that was less that than the advertised expectation;

b)	The repercussions of advertising a product as "Australian Extra Virgin Olive Oil" when it contains imported product;

c)	The repercussions of labelling a product "Extra Virgin Olive Oil" when it does not meet the standards set by the International Olive Oil Council;

d)	The legal requirements for producing olive products in accordance with the Food Safety Acts;

e)	The position where an olive product causes ill health to a consumer;

f)	The requirements for providing olive products for public tasting.
